MV2040 GENERAL PLAN ENVIRONMENTAL IMPACT REPORT NOTICE OF PREPARATION RELEASED
The City of Mill Valley will be preparing an Environmental Impact Report (EIR) for the draft MV2040 General Plan and 2009-2014 Housing Element. The Draft General Plan and Housing element can be found by clicking here.
A General Plan is a “project” as defined by the California Environmental Quality Act (CEQA) and, therefore, subject to an assessment of potential environmental impacts. It’s important to note that the General Plan, itself, is what is reviewed and not any specific development or capital projects that may come about as a result of the General Plan. As such, CEQA actually defines the level of environmental review differently than it does for a specific development project. At the “program” level of review, which is what the General Plan falls under, the potential environmental impacts are assessed according to what the General Plan may call for through its various policy and program recommendations. As this General Plan does not call for any changes in existing land use and development patterns or major new improvements (new roadways, service expansions, etc.) the environmental impacts at the program level are likely to be minimal, and more importantly, the policy and program recommendations in the General Plan will actually serve as mitigations for any potential environmental impacts that may be identified.
The City has released a “Notice of Preparation (NOP)”, which is a requirement of CEQA and allows any interested agencies or members of the public to comment on the scope of the proposed EIR. The NOP can be found by clicking here. The public comment period for a Notice of Preparation is 30 days in length and will close at 5:00 PM on Friday, May 31, 2013. A Notice of Preparation is the first step in the development of an Environmental Impact Report (EIR). At the end of the NOP comment period, any comments will be used in conjunction with information already in the Draft General Plan and Housing Element to produce a Draft Environmental Impact Report (DEIR). The DEIR will be subject to noticed public hearings before the Planning Commission in conjunction with the Draft General Plan and Housing Element. A Final Environmental Impact Report (FEIR) will be produced after the public hearings at the Planning Commission and will be considered by the City Council before adopting the EIR, the General Plan and the Housing Element. Those hearing dates have not been set as yet.
A Scoping Meeting, which is a public meeting, will be held on Tuesday, May 21, 2013 at 6:30 PM in the Mill Valley City Council Chambers, 26 Corte Madera Avenue, Mill Valley. A Scoping Meeting is an opportunity for interested members of the public to learn more about the EIR for the General Plan and Housing Element and comment on the scope of the proposed EIR. The Scoping Meeting is not a public hearing on the Draft General Plan or Housing Element. The public hearing schedule for the Draft General Plan and Housing Element is still being developed and will be announced soon.
