APPROVAL OF AGENDA:

PUBLIC HEARINGS:
1. 450 HILLSIDE – REQUEST TO MODIFY A CONDITION OF APPROVAL AND VARIANCE – File No. DL12-3949(Svanstrom) 
    Modification to a Condition of Approval for an existing Design Review approval to allow the overall height of the garage as constructed (30.4’) to remain in place. A garage over 30 feet would require a Variance. The original project approval was for Design Review, Second Unit Permit, Tree Removal Permit and a Categorical Exemption from CEQA for an extensive remodel of the existing 1,859 square foot house, a 1,760 square foot lower level addition, and the construction of a new detached 618 square foot garage with a 601 square foot second unit beneath it. 
    The parcel is located in a RS-10 (Single-Family Residential 10,000 sq. ft. minimum lot size) zoning district.

2. 167-173 THROCKMORTON AVE. - CONDITIONAL USE PERMIT, VARIANCE, AND MITIGATED NEGATIVE DECLARATION FROM THE REQUIREMENTS OF CEQA- File No. PL14-4166 (Svanstrom) 
    A Conditional Use Permit application to convert four existing apartments into eight hotel rooms
on the upper floor of the structure (approximately 3,600 square feet of building space) and connect these rooms to the Mill Valley Inn. A Variance to the parking requirements is requested to use existing non-conforming parking spaces, with the applicant proposing to use valet parking to address parking needs. The project is located on a 6,313 square foot located at 167-173 Throckmorton Avenue. 
    The subject property is in the Neighborhood-Commercial (C-N) Zoning District and the Downtown Commercial Land Use Designation.

This item (Item #2) will be continued to the December 9, 2014 Planning Commission Meeting.

3. 160 CORTE MADERA - STUDY SESSION FOR REZONING, TENTATIVE MAP, DESIGN REVIEW, AND  ENVIRONMENTAL  REVIEW - File No. D05-3244 (Svanstrom) 
    A proposal to rezone five existing RS-7.5 lots to add a Planned Development overlay; a Tentative Map to reconfigure the 5 existing lots; and Design Review for the renovation/addition to three houses, two new houses, and garage/second units. The applicant is proposing to implement the Historic Alternative outlined in the draft Environmental Impact Report, which includes the renovation and an addition to the Redwood Lodge and the structures at 9 Eldridge and 178 Corte Madera, and new houses at 144 Corte Madera and a vacant parcel. The proposal includes five detached garages (four to include second dwelling units). The project site includes five parcels which currently contain 4 structures known as 178, 160, and 144 Corte Madera and 9 Eldridge. The combined site is 2.57 acres and is currently zoned RS 7.5 (7,500 square foot minimum lot size) with a Historic Overlay on two parcels.

    The intent of the Study Session is to orient the current Commission on the project process to date, introduce the Draft EIR, and provide the applicant with further Planning Commission direction, as necessary, on the overall characteristics of the proposed project. A follow-up public hearing on the Draft EIR will be held in January and will be separately noticed.

4. Adoption of Planning Commission Resolution 14-04 Recommending that the Mill Valley City Council Review and Adopt an Ordinance (EXHIBIT A) Modifying Title 20 “Zoning” of the Mill Valley Municipal Code Establishing Regulations on Ground Floor Professional, Administrative, Real Estate and Other Office Use for Designed Parcels (ATTACHMENT 1) within Downtown Mill Valley (Staude) 
    The Planning Commission will conduct a public hearing to review the proposed amendment to Chapter 20 “Zoning” of the Municipal Code to add section 20.42.030 “Ground Floor Office Use in Downtown,” establishing regulations to conditionally permit ground floor administrative, professional, real estate and other office use for designated parcels within the Downtown area.
